Terms of sale

In force as of 2 October 2026. These general terms and conditions of sale (hereinafter the “Terms”) are entered into between GALAND VANILLE and any natural person not acting as a trader (hereinafter the “Customer” or the “Consumer”) making a purchase on the website www.galand-vanille.com.

1. Purpose and scope

The purpose of these Terms is to define the rights and obligations of the parties in connection with the distance selling of the products offered by GALAND VANILLE to the Consumer via the website www.galand-vanille.com (hereinafter the “Site”).

They apply, without restriction or reservation, to all sales concluded by the seller with consumer Customers, regardless of any clauses that may appear in the Customer’s documents.

Any order placed on the Site implies the Customer’s full and unreserved acceptance of these Terms. The Customer declares that they have read the Terms and accepted them by ticking the box provided for this purpose before confirming their order.

GALAND VANILLE reserves the right to modify these Terms at any time. The applicable Terms are those in force on the date on which the Customer places the order.

3. Products

The products offered for sale are natural vanilla beans and the associated items presented on the Site. Each product is accompanied by a description setting out its essential characteristics, in accordance with Article L.111-1 of the French Consumer Code.

As vanilla is a natural, agricultural product, natural variations in color, texture, size, moisture and aroma from one bean to another are normal and inherent to the product. These variations do not in any way constitute a defect.

The photographs, illustrations and visuals presented on the Site are provided for information purposes only and are not contractually binding. They cannot give rise to the seller’s liability in the event of a reasonable difference between the visual and the product delivered.

The products comply with the French regulations in force relating to foodstuffs.

4. Prices

Product prices are shown in euros (€), including all taxes (VAT included), excluding delivery charges. The applicable VAT is that in force on the day of the order.

Shipping costs are shown in addition to the price of the products and are calculated according to the destination and the delivery method chosen. Their amount is brought to the Customer’s attention before the final confirmation of the order, in the cart summary.

For any delivery outside the European Union (in particular to Switzerland), customs duties, import taxes or local charges may be required by the authorities of the destination country. These taxes and duties remain the sole responsibility of the Customer and are their responsibility alone. GALAND VANILLE has no control over these amounts and cannot predict them.

GALAND VANILLE reserves the right to change its prices at any time, it being understood that products will be invoiced on the basis of the prices in force at the time the order is confirmed.

5. Orders

The Customer places their order online according to the following steps:

  • selecting the products and adding them to the cart;
  • checking the details of the cart (products, quantities, prices, delivery charges);
  • entering their contact details and delivery address;
  • choosing the delivery and payment methods;
  • accepting these Terms;
  • confirming and paying for the order.

Before the final confirmation of their order, the Customer has the possibility of going back to the previous steps in order to check the details of their order and correct any input errors, in particular concerning the products selected, the quantities or their address, in accordance with Article 1127-2 of the French Civil Code.

Confirmation of the order, after confirmation of payment, constitutes conclusion of the contract of sale and acceptance of these Terms. The Customer is invited to check the accuracy of their order before its final confirmation.

A confirmation email summarizing the order is sent to the Customer at the email address provided. This email confirms that the order has been registered.

Product offers are valid while stocks last. GALAND VANILLE endeavors to indicate the availability of products. If a product is unavailable after the order has been placed, the Customer is informed by email as soon as possible and is refunded the amount corresponding to the unavailable product, without any other compensation.

GALAND VANILLE reserves the right to refuse or cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order, or in the event of an abnormal order or one manifestly placed in bad faith.

6. Payment

Purchases are paid for:

  • by bank card (Carte Bleue, Visa, Mastercard) via the secure payment solution of Société Générale;
  • by Apple Pay.

Payment is due immediately upon ordering. The order is considered effective once the bank payment center has confirmed its approval.

Transactions are secure and the data exchanged is encrypted. The Customer’s bank card data is never stored by GALAND VANILLE. It is processed directly by the approved payment service provider, in a secure environment.

GALAND VANILLE reserves the right to suspend or cancel any order and/or delivery in the event of non-payment of any sum owed by the Customer, or in the event of a payment incident.

7. Delivery

Products are shipped by Colissimo / La Poste (tracked Colissimo in France, Colissimo International to the European Union and Switzerland). Some shipments may be entrusted to another carrier (Mondial Relay in particular) depending on the destination and the nature of the order.

Delivery zones. GALAND VANILLE delivers exclusively:

  • in France (mainland and Corsica);
  • in the Member States of the European Union, as well as Andorra and Monaco;
  • in Switzerland.

No delivery is offered outside these zones. The Customer can check whether delivery to their address is available from the cart stage, before any payment.

Lead times: orders are prepared within 2 to 4 working days. The carrier’s transit time, which varies according to the destination, is added to this preparation time. Lead times are given for information purposes only; in any event, in accordance with Article L.216-1 of the French Consumer Code, delivery will take place no later than thirty (30) days after the conclusion of the contract, unless otherwise agreed.

Delivery charges: the amount of the shipping costs is indicated to the Customer before the order is confirmed, according to the destination and the shipping method. In France, pickup-point delivery is free on orders from 45 € and home delivery is free on orders from 80 €. To the European Union and Switzerland, delivery is free on orders from 80 €.

Tracking: a parcel tracking number is provided to the Customer so that they can follow the delivery of their order.

Accuracy of delivery information. The Customer is solely responsible for the accuracy and completeness of the delivery information they provide (address, additional address details, postal code, telephone number, email address, choice of pickup point). GALAND VANILLE cannot be held liable for a failed or late delivery resulting from incorrect, incomplete or out-of-date information provided by the Customer.

7.1 Uncollected parcels and return to sender

When delivery is made to a pickup point, or when the carrier leaves a delivery notice because the parcel could not be handed over in person, the Customer has the holding period set by the carrier (currently fifteen (15) calendar days for Colissimo) to collect their parcel.

At the end of this period, the parcel is automatically returned to GALAND VANILLE by the carrier. The same applies if the Customer refuses the parcel or if delivery is impossible for reasons attributable to the Customer (incorrect or incomplete address, recipient absent and unreachable).

The return of the parcel to the sender is invoiced to GALAND VANILLE by the carrier. These return costs are borne by the Customer, since failure to collect the parcel does not constitute a breach by the seller of its delivery obligation, which has been duly performed.

Applicable charges (France, VAT included):

  • Return-to-sender charge: 2,40 € (amount invoiced to GALAND VANILLE by the carrier, re-invoiced to the nearest euro, without any margin);
  • Reshipping charge: 6,20 € to a pickup point, or 8,30 € for home delivery.

For deliveries to the European Union and Switzerland, return and reshipping costs are re-invoiced at the actual cost borne by GALAND VANILLE, which is communicated to the Customer before any reshipment.

Options available to the Customer. As soon as the returned parcel is received, GALAND VANILLE informs the Customer by email. The Customer then has fourteen (14) days to choose between:

  • reshipment of the parcel, after payment of the return and reshipping charges mentioned above; or
  • cancellation of the order, in which case GALAND VANILLE refunds the price of the products and the initial delivery charges, less the return costs, which remain payable by the Customer.

If the Customer does not respond within this fourteen (14) day period, GALAND VANILLE will refund the price of the products and the initial delivery charges, less the return costs, and the order will be deemed canceled.

These provisions apply without prejudice to the right of withdrawal provided for in Article 8, which the Customer retains in all cases.

7.2 Reservations on receipt

The Customer must check the condition of the parcel and the products on receipt. In the event of damage, or a missing or damaged product, they are invited to state their reservations to the carrier and to inform GALAND VANILLE as soon as possible at contact@galand-vanille.com.

If the seller fails to meet its delivery obligation by the date or within the period indicated, the Customer may, under the conditions of Articles L.216-6 et seq. of the French Consumer Code, terminate the contract after having instructed the seller, in writing, to make the delivery within a reasonable additional period that has expired without result. The Customer is then refunded all sums paid, no later than fourteen (14) days after the termination of the contract.

8. Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer Customer has fourteen (14) days from receipt of the last product in their order to exercise their right of withdrawal, without having to give reasons for their decision or bear any costs other than those provided for below.

Merely failing to collect a parcel does not constitute exercise of the right of withdrawal. A Customer wishing to withdraw must expressly notify GALAND VANILLE under the conditions below. In the absence of notification, the provisions of Article 7.1 apply.

To exercise this right, the Customer notifies their decision to withdraw by means of an unambiguous statement, sent:

The Customer may use the model withdrawal form below, but is not obliged to do so.

The products must be returned in their original condition, complete, unopened and in their intact protective packaging, within fourteen (14) days of communicating the decision to withdraw. Return costs are borne by the Customer.

Refund: GALAND VANILLE refunds all sums paid, including the initial standard delivery charges, no later than fourteen (14) days from the date on which it is informed of the decision to withdraw. The seller may defer the refund until the products have been recovered or until the Customer has provided proof of their dispatch, whichever is earlier. The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees to another means.

Exceptions: in accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised in particular for goods liable to deteriorate or expire rapidly, or for goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection. As vanilla beans are foodstuffs, the right of withdrawal remains fully applicable to any product returned unopened, in its intact original protective packaging. On the other hand, on this basis, the right of withdrawal cannot be exercised for food products whose protective packaging has been actually opened or unsealed by the Customer after delivery, as these products can no longer be returned to the sales circuit for reasons of hygiene and health protection.

9. Legal guarantees

Independently of any commercial guarantee, the Customer benefits from the following legal guarantees:

Legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code). GALAND VANILLE is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The Customer has two (2) years from delivery of the goods to take action. They may choose between repair or replacement of the goods, subject to the cost conditions provided for by law. The Customer is exempt from proving the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods. The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The Customer may decide to invoke the guarantee against hidden defects in the item sold. In this case, they may choose between cancellation of the sale or a reduction of the sale price, in accordance with Article 1644 of the French Civil Code. Any action resulting from redhibitory defects must be brought within two (2) years of discovery of the defect.

Summary box of the legal guarantees.

  • The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.
  • The legal guarantee of conformity entails the obligation to provide goods that conform to the contract and are free from any lack of conformity. It entitles the consumer, at their choice, to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience to them.
  • If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
  • If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.
  • The consumer may obtain a reduction in the purchase price by keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if repair and replacement of the goods are impossible or cannot be carried out within one month of the consumer’s complaint, or if these solutions cause major inconvenience to the consumer.
  • The consumer is also entitled to this solution if the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.
  • The consumer may not terminate the contract if the lack of conformity is minor.
  • Any period during which the goods are immobilized for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
  • Independently of the legal guarantee of conformity, the consumer may decide to invoke the guarantee against defects in the item sold within the meaning of Article 1641 of the French Civil Code, within two years of discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

Commercial guarantee. GALAND VANILLE does not grant any commercial guarantee in addition to the legal guarantees described above. The legal guarantees of conformity and against hidden defects apply in all cases, at no cost to the Customer.

Quality commitment. GALAND VANILLE takes particular care in the selection, packing and packaging of its products in order to preserve their quality during transport. If a product is delivered defective, damaged or broken (in particular a broken glass tube), the Customer is invited to contact GALAND VANILLE at contact@galand-vanille.com, attaching photographs if possible, as soon as possible after receipt. After verification, GALAND VANILLE will replace the product or refund it, as agreed with the Customer, at no additional cost to the Customer.

10. Personal data

The personal data collected in connection with the order is necessary for its processing, for delivery and for managing the customer relationship. It is processed in accordance with the General Data Protection Regulation (GDPR) and the “Informatique et Libertés” law.

The Customer has, in particular, the right to access, rectify, erase, object to, restrict and port their data, which they can exercise by writing to contact@galand-vanille.com.

For more information on the collection and processing of their data, the Customer is invited to consult the Privacy policy available on the Site, which supplements these Terms.

11. Consumer mediation

In accordance with Article L.612-1 of the French Consumer Code, the consumer Customer has the right to use a consumer mediator free of charge with a view to the amicable resolution of any dispute with GALAND VANILLE, provided that they have first attempted to resolve the dispute directly with the seller by means of a written complaint.

The competent consumer mediator is: currently being appointed. Their contact details (name, postal address and website) will be updated here as soon as they have been appointed. The mediator’s full contact details will be provided here as soon as GALAND VANILLE has finalized its membership of a consumer mediation scheme.

12. Intellectual property

All content on the Site — texts, descriptions, photographs, maps and illustrations created by Mr Paul Galand, logos, the “Galand Vanille” trademark, graphic identity and layout — is protected by intellectual property law and copyright. These elements are the exclusive property of GALAND VANILLE or of their author.

Any reproduction, representation, modification, publication, adaptation or exploitation, in whole or in part, of these elements, by any process whatsoever and on any medium whatsoever, is prohibited without the prior written authorization of GALAND VANILLE, failing which it will constitute an infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

13. Force majeure

GALAND VANILLE cannot be held liable for any failure or delay in the performance of any of its obligations resulting from a case of force majeure, as defined in Article 1218 of the French Civil Code and by the case law of the French courts.

The following are considered, in particular, as cases of force majeure: natural disasters, fires, floods, epidemics, total or partial strikes, blockages of means of transport or supply, failures of telecommunication networks, as well as any event beyond the reasonable control of the parties. The affected obligations are suspended for the duration of the force majeure event; if it lasts more than thirty (30) days, the parties may terminate the contract automatically.

14. Applicable law and disputes

These Terms and the sales resulting from them are governed by French law. Only the French language is authoritative; in the event of a translation, the French version prevails.

In the event of a dispute, the Customer shall first contact GALAND VANILLE in order to seek an amicable solution. Failing an amicable resolution, and after any recourse to the consumer mediation referred to in Article 11, the dispute may be brought before the competent courts under the conditions of ordinary law. The consumer Customer may, at their choice, refer the matter to one of the courts with territorial jurisdiction under the French Code of Civil Procedure, or to the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
